Homebuyers Struggle as MahaRERA Faces Delays in Case Resolution

Homebuyers in Maharashtra are struggling to get relief from the Maharashtra Real Estate Regulatory Authority (MahaRERA), which was established to address real estate grievances. With nearly 8,000 complaints pending and delays in executing its orders, including recovery warrants by revenue authorities, experts believe the regulator lacks enforcement power. A homebuyer who invested in a Goregaon project has been waiting since January 2024 for the execution of an order directing the builder to sign an agreement for sale. Despite MahaRERA imposing a penalty on the builder, the fine remains uncollected, highlighting the authority’s inefficiency in enforcing its rulings.

MahaRERA has also faced criticism for its slow case resolution, with hearings delayed for over two years due to a limited number of members. Some complaints filed in 2021 and 2022 are still awaiting a hearing, causing frustration among homebuyers. However, current MahaRERA chairman Manoj Saunik has been making efforts to speed up the process, recently hearing a record number of cases in a single day. Experts suggest that the government should increase the number of MahaRERA members and implement a streamlined system to ensure faster disposal of complaints and effective execution of orders.
