The Maharashtra Real Estate Regulatory Authority (Maha RERA) has instructed Godrej Properties to refund the entire booking amount of Rs 15 lakh to a senior citizen who cancelled their booking within 10 days for a luxury project in Kurla, Mumbai. Despite Godrej’s claim that the booking occurred before the project was registered with Maha RERA in July 2017 and thus should not fall under the regulator's jurisdiction, Maha RERA ruled that the project was ongoing when the Real Estate (Regulation and Development) Act, 2016, came into effect. The regulator noted that forfeiting the booking amount violated the act’s intention to protect homebuyers from such hardships.
This order comes amid other similar rulings against Godrej Properties, including recent cases where the company was ordered to refund substantial amounts to buyers after canceling agreements for various reasons. For instance, Maha RERA directed the refund of Rs 97 lakh in one case involving an NRI homebuyer and instructed a partial refund in another instance for a buyer of the Godrej Emerald project. The regulator continues to uphold consumer protection mandates under RERA, emphasizing fair trade practices in real estate transactions.
