The Maharashtra Real Estate Regulatory Authority (MahaRERA) is considering a proposal to mandate developers to include details of amenities and their availability deadlines in the agreement for sale. This move aims to eliminate uncertainty surrounding promised facilities in housing projects. Currently, the model agreement for sale lacks specificity regarding amenities, leading to potential disputes. The proposed order would require developers to specify the exact date for the availability of amenities like swimming pools, gyms, and community centres, along with their features and size.
Residents and homebuyers have expressed support for this initiative, citing instances of delayed amenities due to phased construction. If implemented, the mandatory inclusion of amenity details in the agreement for sale could ensure timely completion of facilities in housing projects. MahaRERA emphasises that this provision would become an irrevocable clause in the model agreement for sale, alongside clauses covering force majeure, liability period, carpet area, conveyance, and parking.
