The Supreme Court has overturned the National Green Tribunal's (NGT) October 2020 decision to close Pune Municipal Corporation's (PMC) garbage processing plant in Baner. The court ruled that the NGT erred in its judgement and permitted PMC and its contracted agency, Noble Exchange Environment Solution Pune LLP, to continue operating the plant under strict conditions. These include biannual audits by the National Environmental and Engineering Research Institute (NEERI) and implementation of their recommendations to minimise bad odour, ensuring minimal disruption to nearby residents.
The court highlighted that closing the plant would harm the public interest, as it would require transporting organic waste from Pune's western parts to Hadapsar, causing further public nuisance. The bench also dismissed the original plea filed by the Sus Road Baner. Additionally, the court ordered several measures, including the installation of odour control systems, better infrastructure, and enhancing green cover through Miyawaki forests to reduce the environmental impact of the plant.
